Listen, I’m not an antitrust lawyer so I have no idea if Kroger’s attempted takeover of Albertsons from 2022 violated any laws. But when the Biden-era Federal Trade Commission said it did, the deal was dead and both companies moved on. Or so we thought. This week Albertsons filed a $9 billion lawsuit against Kroger accusing it of messing up the deal. C’mon Albertsons, this is coming up two years from the day the deal was nixed and you’re just now getting around to filing a lawsuit? What does this say about your sense of urgency, perhaps reflecting the culture of your entire company? Again, I don’t know who’s right and who is wrong, but it seems to me that when a company says it’s been done wrong with something this big, it’s got to move faster to try to seek justice. Under a different CEO, Albertsons might have gotten a different outcome, so maybe they are now counting on the courts to back them up. But if I were Albertsons’ management, I’d be focused on running their business not rehashing old history. The shelf life on this one is way past its expiration date.
